These Terms and Conditions ("Terms and Conditions" or "Agreement") govern the relationship between Vacations by Linda LLC, doing business as Destinations by Linda ("DBL," "we," "us," or "our") and you, the purchaser or traveler ("Client," "passenger," "you," or "your"). By planning travel with DBL, requesting our services, or making a payment toward any travel booking, you agree to be bound by these Terms and Conditions and acknowledge that DBL acts solely as a booking agent for disclosed principal suppliers — including but not limited to tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation providers, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and travel-related services (collectively, "Suppliers") — and is not the source or provider of those travel services. These Terms include warranties, disclaimers, and exclusions of liability that may restrict your rights and remedies and provide protection to DBL.

1. Use of DBL Services, Access, and Information for Travel Bookings

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with DBL. You agree to be financially responsible for all travel bookings made with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you — on behalf of yourself, members of your household, or others for whom you are authorized to transact business — is true, accurate, and complete.

You agree that you will only make legitimate reservations or purchases with DBL and its Suppliers, and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.

DBL accepts all bookings solely as the booking agent for travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services. By booking travel through DBL, you agree to be bound by the booking terms and conditions of each Supplier selected for your itinerary.

DBL is not liable or responsible for any travel arrangements made independently of DBL. DBL assumes no responsibility for costs or fees you incur for independent arrangements — including but not limited to airline, hotel, excursion, and travel protection charges — not booked through DBL. If you make your own flight arrangements, DBL is not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates, and cannot assist with schedule changes or delays related to air reservations made independently. Frequent flyer or other loyalty points may not be earned on reservations made through DBL.

Seller of Travel Registrations: DBL operates as an independent affiliate of WorldVia Travel Group. Florida Seller of Travel Registration No. [FL SOT # ]. Additional state registrations may apply. Registration as a Seller of Travel does not constitute approval by any state.

2. Planning Fees and Service Fees

DBL may charge a planning fee or service fee depending on the nature and complexity of your travel request. The following terms apply to all such fees:

a. Fee Disclosure. Any applicable planning or service fee will be disclosed to you in writing prior to DBL commencing work on your itinerary. Fees will be communicated via email or a written proposal and must be agreed upon by both parties before work begins.

b. Complimentary Planning. Certain travel bookings — including but not limited to straightforward all-inclusive resort reservations — may be offered with complimentary planning at DBL's sole discretion. Complimentary planning does not waive any other fees or obligations described in these Terms.

c. Fee Payment. Planning and service fees are payable directly to DBL and are due at the time specified in your written fee agreement. Fees are separate from and in addition to the cost of any travel arrangements booked on your behalf.

d. Non-Refundability. Planning and service fees compensate DBL for time, research, consultation, and administrative work invested on your behalf. Unless otherwise stated in writing, planning and service fees are non-refundable once work has commenced, regardless of whether a booking is ultimately completed.

e. Travel Insurance and Fees. Planning and service fees may be eligible for reimbursement under certain travel insurance policies — specifically under Trip Cancellation or Cancel for Any Reason (CFAR) coverage — if you cancel your trip for a covered reason. DBL recommends reviewing your travel insurance policy to understand what fees may be recoverable. DBL cannot guarantee that any insurer will approve a claim for such fees.

3. Payments, Cancellations, and Changes to Bookings

a. Client Responsibility for Charges. You are completely responsible for all charges, fees, duties, taxes, and assessments arising from your travel bookings through DBL.

b. Payment Authorization. By authorizing payment through Tern (DBL's travel management platform), by submitting a Credit Card Authorization Form to DBL, or by authorizing payment through any other means accepted by DBL, you agree to allow DBL to apply your authorized payment toward the purchase of travel products from our Suppliers on your behalf. Planning fees paid directly to DBL are separate from Supplier payments and are processed independently.

Where DBL uses a Credit Card Authorization Form, that form is incorporated into and subject to these Terms and Conditions. By signing or electronically approving a Credit Card Authorization Form, you authorize DBL to charge the payment method listed on that form for the amounts and purposes described therein. DBL will retain authorization records in accordance with applicable law and payment processor requirements.

c. No Chargebacks. EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF DBL OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF DBL OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE, OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT OR PLANNING FEE, DBL RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES, AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL, OR RECOLLECTION, INCLUDING WITHOUT LIMITATION ATTORNEY FEES.

d. Payment Deadlines. All payments for travel are due prior to departure according to each Supplier's terms and conditions. Failure to make final payment or any violation of a Supplier's conditions may result in cancellation of your reservation and forfeiture of all amounts paid.

e. DBL Cancellation and Change Fee. In addition to any cancellation or change penalties assessed by Suppliers, DBL charges a $50.00 administrative fee per booking for any cancellation or modification to a confirmed reservation. This fee compensates DBL for the administrative work involved in processing the cancellation or change and applies regardless of the reason for the cancellation or modification, including Force Majeure events. This fee is separate from and in addition to any Supplier penalties. As noted in Section 2(e) above, this fee may be recoverable through applicable travel insurance coverage.

f. Written Requests Required. All cancellation and change requests must be submitted to DBL in writing to hola@destinationsbylinda.com. Verbal requests will not be accepted. The date on which DBL receives your written request will be used to determine applicable cancellation penalties.

g. No Refund for Unused Services. When tour, cruise, or package prices are based on Suppliers' contract rates, you will not be entitled to any refund for any unused portion of travel.

4. Group Travel — Special Terms

The following additional terms apply to all group travel bookings, defined as any booking involving two (2) or more travelers traveling together under a coordinated itinerary or shared reservation.

a. Individual Cancellation within a Group. Each traveler in a group is individually responsible for their own booking, payments, and cancellation obligations. If one or more travelers cancel after a group rate has been established, the cancellation may affect the pricing, room assignments, or qualification for group benefits for remaining travelers. Any increase in per-person pricing, single supplement charges, or loss of group perks resulting from an individual cancellation is the sole responsibility of the cancelling traveler, not DBL and not the remaining group members. DBL will make reasonable efforts to mitigate the impact of individual cancellations but cannot guarantee that group rates, perks, or room configurations will be maintained.

b. Minimum Traveler Requirements. Group rates, perks, and discounts offered by Suppliers are typically contingent on maintaining a minimum number of travelers or rooms ("Group Minimum"). If the group falls below the Group Minimum for any reason — including individual cancellations, payment failures, or other withdrawals — DBL cannot guarantee that the group rate will be maintained. In such cases, remaining travelers may be subject to current individual pricing, which may be higher than the original group rate. Each remaining traveler is responsible for any resulting price difference.

c. Group Organizer Responsibilities. The individual who initiates the group booking ("Group Organizer") serves as the primary point of contact for DBL and is responsible for:

  • Communicating all trip details, deadlines, payment schedules, and terms to individual group members

  • Ensuring all group members receive and acknowledge these Terms and Conditions

  • Notifying DBL promptly of any changes to group composition

DBL is not responsible for any miscommunication, missed deadlines, or disputes arising from the Group Organizer's failure to communicate information to individual group members. Individual travelers who book through their own Tern payment link are personally responsible for their own booking obligations and payments.

d. Roommate and Room Share Changes. If two travelers are sharing a room and one traveler cancels or withdraws, the remaining traveler will be subject to a single supplement charge as required by the Supplier. This charge is the sole responsibility of the cancelling or withdrawing traveler. DBL will make reasonable efforts to identify an alternative roommate upon request, but cannot guarantee one will be available.

e. Late Additions. Travelers who wish to join an existing group booking after the initial reservation has been confirmed ("Late Additions") are subject to current availability and pricing at the time of their request. Late Additions are not guaranteed to receive the original group rate, room category, or perks. Late Addition requests must be submitted in writing to DBL and are subject to Supplier approval.

f. Individual Traveler Responsibility. Once a traveler's individual booking link (issued through Tern or another payment platform) has been activated, that traveler assumes full individual responsibility for their own booking, payment schedule, and compliance with Supplier terms and conditions. DBL will make reasonable follow-up efforts on behalf of the Group Organizer but is not responsible for individual travelers who fail to complete payment, do not respond to communications, or otherwise fail to meet their booking obligations. Non-payment by individual group members does not obligate DBL or the Group Organizer to cover the outstanding balance.

5. Right to Correct Errors and Offers Subject to Availability

DBL reserves the right to correct any pricing errors or omissions. In the event of any pricing error, DBL reserves the right to adjust such pricing or make other corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. Clients are advised to confirm reservations well in advance of anticipated travel dates.

6. Travel Documents, Including TSA and DHS Identification Requirements

It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. The U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that all travelers carry acceptable identification to board a flight. Certain countries will not admit a passenger whose passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation, and you are responsible for making DBL aware when traveling on a passport issued by a country other than the United States.

DBL neither controls nor warrants the issuance of visas or approval of visa waivers. If a visa is not issued, DBL is not responsible for any payments lost as a result.

Children and minors may require additional travel documents. Minors traveling with one parent or without both parents may be stopped at the border unless authenticated consent documentation is provided. See https://help.cbp.gov for current requirements.

The name, date of birth, and gender on your identification must exactly match the information on your tickets and booking records. It is your responsibility to verify the accuracy of all travel documents upon receipt. WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, REVIEW ALL INFORMATION IMMEDIATELY. CONTACT DBL WITHIN TWENTY-FOUR (24) HOURS IF CORRECTIONS ARE NEEDED. DBL BEARS NO RESPONSIBILITY FOR ADDITIONAL COSTS RESULTING FROM CORRECTIONS REQUESTED AFTER THIS WINDOW.

7. Individual Entry and Exit Requirements

Each country maintains its own entry and exit requirements, including policies regarding prior criminal offenses. If you have a current or prior criminal offense, it is your responsibility to contact the relevant country directly for entry requirements prior to booking. See https://travel.state.gov for additional information. DBL does not inquire about criminal history.

8. Immunizations and Health Screenings

You are responsible for obtaining all required immunizations, health screenings, and documentation before travel. DBL does not assume responsibility for the accuracy of health, vaccination, or documentation requirements. In some cases, inoculations must be recorded on a valid vaccination certificate. Consult your healthcare provider before booking if you have concerns about any required medications or immunizations. 9. Accessibility, Travelers with Disabilities, and Special Travel Needs

Travelers with disabilities or special needs who require non-emergency accommodations, special services, or assistive equipment should advise DBL prior to booking. DBL will make reasonable efforts to request appropriate accommodations from Suppliers. Additional charges may apply for rental of specialized equipment. Airlines may impose restrictions on mobility devices and may charge additional baggage fees.

When traveling outside the United States or Canada, local laws and regulations may apply different standards of accommodation for travelers with disabilities. DBL is not responsible for a Supplier's failure to meet the needs of travelers with disabilities when the Supplier is complying with applicable local law.

DBL RECOMMENDS THE PURCHASE OF COMPREHENSIVE TRAVEL INSURANCE ON ALL BOOKINGS, INCLUDING COVERAGE FOR MEDICAL EMERGENCY, EVACUATION, AND PRESCRIPTION MEDICATION ACCESS.

10. Risks and Safety

Travel to certain destinations may involve greater risk than others. DBL urges Clients to remain informed about current news events and to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government before booking international travel. Resources include: http://www.state.gov, http://www.tsa.gov, http://www.cdc.gov, and https://step.state.gov/step/.

BY OFFERING TRAVEL TO PARTICULAR DESTINATIONS, DBL DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH DESTINATIONS IS ADVISABLE OR WITHOUT RISK. DBL SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES RESULTING FROM TRAVEL TO SUCH DESTINATIONS. CLIENT'S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT'S OWN RISK.

Certain activities on your itinerary may pose inherent risks. By booking with DBL and participating in any such activities, you acknowledge awareness of these risks and agree to use required safety equipment.

If you use, consume, or are under the influence of alcohol or illegal drugs prior to or during any activities on your itinerary, YOU ASSUME AND ACCEPT ALL RISKS, DANGERS, AND HAZARDS THAT MAY RESULT, and you indemnify DBL from any resulting liability.

11. Hazardous Materials

Federal law prohibits passengers from bringing hazardous materials on aircraft. Violations can result in imprisonment and significant financial penalties. For a full list of prohibited items, see http://www.tsa.gov/traveler-information/prohibited-items.

12. Air Travel, Schedule Reconfirmation, and Check-In

Your airline ticket is a contract between you and the air carrier, even if purchased through DBL. DBL does not control airline operations and is not liable for personal injury, property damage, schedule changes, fees, or cancellations related to air travel. DBL assumes no responsibility for air schedule changes.

It is strongly recommended that you check in at least 2 hours before domestic flights and 3 hours before international flights. Reconfirm flight times at least 24 hours before domestic departures and 72 hours before international departures.

Frequent flyer mileage accrual is at the discretion of the airline. DBL has no liability if accrual of miles is denied or if upgrades are unavailable. Seat assignments are not guaranteed even after assigned; DBL has no control over airline seating.

13. Limitations of Responsibility and Disclosure

DBL acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of DBL.

DBL is not responsible for a Supplier's failure to accommodate dietary restrictions, medical needs, or special requests.

Any alterations to an itinerary are at the sole discretion of the Supplier, and DBL bears no responsibility for any resulting changes.

BECAUSE DBL ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS, YOU AGREE THAT DBL IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM THESE SERVICES. DBL HEREBY DISCLAIMS ANY LIABILITY — WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE — INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES IN CONNECTION WITH GOODS OR SERVICES PROVIDED BY ANY SUPPLIER, INCLUDING LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY, OR IRREGULARITY ARISING THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OR OMISSIONS OF SUCH SUPPLIER, INCLUDING THEIR FAILURE TO DELIVER SERVICES, CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS.

DBL'S LIABILITY, IF ANY, IS LIMITED TO THE AMOUNT OF PLANNING FEES AND COMMISSIONS ACTUALLY RECEIVED BY DBL IN CONNECTION WITH YOUR SPECIFIC BOOKING.

14. Force Majeure

DBL will not be in breach of these Terms or otherwise liable to you for any failure or delay in performing obligations under this Agreement due to causes beyond its reasonable control, including but not limited to: acts of God, accident, riots, war, terrorist acts, epidemic, pandemic, quarantine, civil commotion, breakdown of communication or technology systems, destruction of facilities, natural catastrophes, extreme weather events, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, or any other unforeseen circumstance beyond DBL's control.

THE PURCHASE OF TRAVEL INSURANCE — INCLUDING CANCEL FOR ANY REASON (CFAR) COVERAGE — IS HIGHLY RECOMMENDED ON ALL TRIPS.

In the event of a Force Majeure, Suppliers may in their sole discretion vary, postpone, or cancel any itinerary. Refund decisions remain at each Supplier's sole discretion per their individual policies, though DBL will use reasonable efforts to advocate for reimbursement on your behalf.

Please note that DBL's $50.00 administrative cancellation fee (Section 3(e)) applies regardless of Force Majeure events, as it compensates DBL for administrative work already performed.

14a. Currency Fluctuations

Currency exchange rates fluctuate and are outside of DBL's control. Prices for international travel are subject to change based on currency exchange rate fluctuations between the time of booking and the time of final payment. DBL is not responsible for surcharges or foreign transaction fees imposed by your credit card issuer or bank. DBL recommends confirming your card's foreign transaction fee policy before authorizing payment for international travel.

15. Client Conduct

All travelers are expected to act responsibly and adhere to behavior guidelines established by DBL and its Suppliers, including applicable dress codes at religious, cultural, or resort properties. DBL and all Suppliers reserve the right to remove any traveler from a property, tour, or transportation if their conduct endangers themselves or others, disrupts other guests, or interferes with operations. No refund will be issued in such cases.

You accept responsibility for any damage or loss caused by you or members of your traveling party. Baggage and personal effects are at all times the sole responsibility of the traveler. Any transportation, possession, or use of illegal drugs will result in immediate termination of your trip without refund.

16. Travel Insurance

DBL STRONGLY RECOMMENDS THE PURCHASE OF COMPREHENSIVE TRAVEL INSURANCE ON ALL BOOKINGS. Travel insurance is not included in the cost of any itinerary unless specifically noted in writing. Without appropriate travel insurance, cancellation, interruption, or unexpected events may result in partial or total loss of all amounts paid, including planning fees.

Available coverages may include: trip cancellation, trip interruption, Cancel for Any Reason (CFAR), medical emergency, medical evacuation and repatriation, baggage and personal effects, travel delay, missed connections, and more.

DBL is not a licensed insurance broker and its advisors are not qualified to evaluate the adequacy of any insurance coverage or answer technical questions about policy terms, benefits, or exclusions. It is your responsibility to review your policy and ensure it meets your needs. DBL cannot guarantee that any insurer will approve any claim.

The $50.00 DBL administrative cancellation fee described in Section 3(e) may be recoverable under Trip Cancellation or Cancel for Any Reason (CFAR) coverage depending on your specific policy and the reason for cancellation. Clients are encouraged to review their policy or contact their insurer directly to confirm.

Purchase of travel insurance is not required to book travel through DBL. However, if you decline to purchase insurance, DBL may require you to sign an insurance waiver.

17. Reservation of Rights and Changes to These Terms

DBL reserves the right, in its sole discretion, to update or modify these Terms and Conditions at any time. Updated versions will be provided to active Clients, posted on DBL's website, and are effective immediately upon posting.

18. General Provisions

The laws of the State of New Jersey govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of the courts of Morris County, New Jersey for all disputes arising out of or relating to travel bookings with DBL.

Any claim against DBL must be brought within twelve (12) months after the completion of the trip at issue, or if the trip did not occur, within twelve (12) months of the originally scheduled departure date.

DBL shall not be liable for punitive or exemplary damages. You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class action or representative proceeding. You expressly waive all rights to bring any class action, proposed class action, or representative action against DBL.

If any portion of these Terms is found invalid or unenforceable under applicable law, the invalid provision will be replaced with a valid, enforceable provision that most closely matches the original intent, and the remainder of the Agreement will continue in effect.

These Terms and Conditions constitute the entire agreement between you and DBL with respect to travel bookings made with DBL, superseding all prior communications, representations, or agreements — whether oral, written, or electronic.

19. Companion Client Documents

The following documents are used alongside these Terms and Conditions and are incorporated by reference where applicable. Clients may be required to complete one or more of these forms as part of the booking process:

  • Credit Card Authorization Form — Required when a client authorizes DBL to charge a payment method on their behalf for Supplier payments. Clients will receive this form separately and must complete it prior to DBL processing any payment.

  • General Travel Booking Form / Client Intake Form — Collects trip preferences, traveler details, and other information needed to begin the planning process. Completion of this form constitutes your request for services and confirms your agreement to these Terms.

  • Travel Insurance Waiver — Required if a client declines travel insurance. By signing the waiver, the client acknowledges the risks of traveling uninsured and releases DBL from liability for losses that would otherwise have been covered.

  • Group Travel Addendum — For group bookings involving [X] or more travelers, a separate Group Travel Addendum may be required detailing group-specific payment schedules, minimum traveler requirements, and organizer responsibilities.
